On Tuesday morning, world no. 20 Nick Kyrgios requested a dismal in his assault case against ex-girlfriend Chiara Passari due to his mental condition.
An alleged incident in January 2021 involving his former partner has led to an accusation of common assault against Nick Kyrgios, who is presently competing at the 2022 Japan Open in Tokyo.
Kyrgios' lawyer Michael Kukulies-Smith requested that the ACT Magistrates Court in Canberra handle his accusation under Section 334 of the Crimes Act, which allows the court the authority to dismiss a charge if it is satisfied the accused is mentally incompetent, during a court hearing on Tuesday.
On February 3, 2023, a hearing about the adjournment request will be held. "My client's preference is to attend in person," Kukulies-Smith added.
When asked about it in Tokyo, he said: "There's only so much I can control and I'm taking all the steps and dealing with that off the court," Kyrgios said.
"I can only do what I can and I'm here in Tokyo and just trying to play some good tennis, continue that momentum and just try to do my job - and that's play tennis, play it well. That's it."
