Nick Kyrgios won't be present for Court appereance

Nick Kyrgios was scheduled to respond to a charge of common assault stemming from an alleged incident in January.

Early August was the originally scheduled time, but Kyrgios has been in the US competing in the ATP Tour. Nick Kyrgios won't appear when the case is first brought up, but he will be defended by Canberra attorney Michael Kukulies-Smith.

The allegations against Kyrgios stem from an incident involving his ex-girlfriend Chiara Passari. Reports and accounts of the occurrences varied significantly, and no legal conclusions have been made in this situation. The trial, which is a criminal matter, may very easily interfere with Kyrgios' time on the road and, if he is found guilty, may result in jail time.

He will contest the US Open after which he will return to Australia. It begins next Monday.
